1. About us

The website vellmont-co.com and the Vellmont online store (the "Store") are operated by JOFAB LLC, a Florida limited liability company with its business address at 25034 Luke St, Christmas, FL 32709, United States ("Vellmont", "we", "us", "our"). You can contact us at contact@vellmont-co.com.

These Terms of Service ("Terms") apply to your use of the Store and to every purchase you make from us. By using the Store or placing an order, you agree to these Terms. Please read them together with our Refund Policy, Shipping Policy and Privacy Policy, which form part of these Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your country, to place an order. Our products are sold to consumers for personal use and not for resale.

3. Products and information

We make every effort to describe and display our products accurately, including colors, materials and sizes. Colors may vary slightly depending on your screen, and measurements may vary slightly between items. Please check the size guide on each product page before ordering. All products are subject to availability.

4. Prices and payment

Prices are shown at checkout in the currency displayed and include VAT where applicable. Shipping charges, if any, are shown before you complete your purchase. If you pay in a currency different from your card's currency, your bank may apply conversion fees. Payment is taken at the time you place your order through our secure payment providers; we do not store your full card details.

If a product is listed at an obviously incorrect price due to an error, we will contact you before dispatch and you may choose to confirm the order at the correct price or cancel it for a full refund.

5. Orders and contract

When you place an order, you will receive an email acknowledging it. A contract between you and Vellmont is formed when we send you this order confirmation. We may decline or cancel an order before dispatch — for example if a product is unavailable, if there is a pricing error, or if we suspect fraud — in which case you will receive a full refund.

You may cancel your order free of charge before it has been dispatched by emailing us. After dispatch, you can return your order under our Refund Policy.

6. Shipping and delivery

Delivery times and conditions are described in our Shipping Policy. Risk of loss and damage passes to you when the goods are delivered to you or to a person you designate.

7. Returns and right of withdrawal

You may return items within 30 days of delivery, free of charge, as described in our Refund Policy. Consumers in the EU and the UK also have a statutory right to withdraw from the contract within 14 days of delivery without giving a reason; our 30-day return window includes and extends this right.

8. Legal guarantee

We are responsible for any lack of conformity of the goods in accordance with applicable law. Consumers in the EU benefit from a legal guarantee of conformity of at least two years from delivery. Nothing in these Terms limits your statutory rights.

9. Intellectual property

All content on the Store — including the Vellmont name and logo, text, photos, graphics and design — belongs to us or our licensors and may not be copied, reproduced or used for commercial purposes without our written permission.

10. Acceptable use

You agree not to use the Store for any unlawful purpose, to interfere with its security or operation, to submit false information or fraudulent orders, or to use automated means to access or copy its content.

11. Third-party services and links

The Store is hosted on Shopify and uses third-party services such as payment providers and carriers. The Store may also contain links to third-party websites. We are not responsible for the content or practices of third-party websites.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when the contract was formed, or for delays or failures caused by events beyond our reasonable control. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded or limited under applicable law, including your rights as a consumer.

13. Privacy

We process your personal data as described in our Privacy Policy.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your country of residence. We encourage you to contact us first at contact@vellmont-co.com so we can try to resolve any issue amicably.

15. Changes to these Terms

We may update these Terms from time to time. The version in force when you place your order applies to that order.
